Terms of Service

These Terms of Service ("Terms") govern your use of the Titan Dialer platform operated by Titan Dialer ("we," "us," or "our"). By creating an account or using our services, you agree to these Terms.

1. Service Description

Titan Dialer is a cloud-based contact center platform that provides inbound call routing, outbound dialing, IVR, ACD, call recording, real-time monitoring, and related telephony services via a web-based interface.

2. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or legal entity may not maintain more than one account without prior approval
  • You are responsible for all activity that occurs under your account

3. Acceptable Use

You agree NOT to use the platform to:

  • Make calls in violation of the Telephone Consumer Protection Act (TCPA) or any applicable telemarketing laws
  • Initiate robocalls or auto-dialed calls without proper consent
  • Call numbers on the National Do Not Call Registry without a valid exemption
  • Transmit fraudulent, threatening, harassing, or illegal content
  • Engage in caller ID spoofing for deceptive purposes
  • Resell or redistribute the service without written authorization
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the platform for any purpose that violates applicable laws or regulations

4. Billing and Payment

Platform Fee

A monthly platform fee is charged for access to the Titan Dialer platform. This fee is billed at the beginning of each billing cycle and is non-refundable.

Usage Charges

  • Per-minute calling rates are charged based on actual call duration
  • Calls are billed in 6-second increments
  • Phone numbers (DIDs) are billed monthly at the published rate
  • Usage charges are deducted from your prepaid balance in real time

Prepaid Balance

  • You must maintain a positive prepaid balance to make or receive calls
  • When your balance reaches zero, outbound calling will be paused
  • Top-ups can be made via credit card or other accepted payment methods
  • Prepaid balances are non-refundable except as required by law

5. Service Level

We strive to maintain 99.9% platform uptime. However, we do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for service interruptions caused by third-party providers, internet outages, or force majeure events.

6. Call Recording

  • Call recording features are provided as a tool for quality assurance and training
  • You are solely responsible for complying with all applicable recording consent laws in your jurisdiction and the jurisdiction of the called party
  • Some jurisdictions require all-party consent before recording a call
  • We are not responsible for your failure to obtain proper consent

7. Data Ownership

  • You retain ownership of all data you upload to the platform (leads, contacts, recordings)
  • You grant us a limited license to process your data as needed to provide the service
  • We will not access your data except to provide the service, respond to support requests, or comply with legal obligations
  • Upon account termination, you may request export of your data within 30 days

8. Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account has an outstanding unpaid balance for more than 30 days
  • We receive complaints of illegal calling activity from your account
  • We are required to do so by law or regulatory authority

You may cancel your account at any time by contacting support. Upon cancellation, your remaining prepaid balance will not be refunded except as required by applicable law.

9. Limitation of Liability

To the maximum extent permitted by law, Titan Dialer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Titan Dialer and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any applicable law.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
